Terms of Use

Last updated: 20 September 2026

These Terms of Use (“Terms”) form a legally binding agreement between you and Jernkvern AS (org. no. 938 506 639), Norway, the company that owns and operates Kinfeed (“Kinfeed”, “we”, “us”, “our”). They govern your use of:

  • the kinfeed.com marketing website (the “Website”); and
  • the Kinfeed mobile application and any related services we provide (collectively, the “Service”).

By accessing the Website or using the Service, you agree to these Terms. If you do not agree, do not use the Website or the Service.

The Service is presented again, with full Service-specific terms, when you create an account in the app. Those in-app terms govern your use of the Service. Where they conflict with these Terms, the in-app terms control for Service use; these Terms control for the Website.

1. Eligibility and accounts

You must be at least 13 years old to create an account. If you are between 13 and 16, your parent or legal guardian must give consent before you sign up.

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at kontakt@kinfeed.com if you believe your account has been compromised.

2. Your content

The Service lets you upload photographs and related material (“User Content”) and share it with people you invite to your private group(s). With respect to User Content:

You retain ownership. You keep all rights you have in your User Content. We do not claim ownership of your photos.

You grant us a limited licence. Solely to operate, secure, back up, transmit, and display the Service to you and the people in your private group(s), you grant Kinfeed a worldwide, non-exclusive, royalty-free licence to host, store, transmit, reproduce, adapt (only for technical purposes such as resizing, format conversion, and thumbnail generation), and display your User Content. This licence ends when you delete the relevant User Content from the Service or close your account, except to the extent the content has been retained or shared by other group members or backed up in routine system processes (which we will purge in accordance with our retention schedule).

You are responsible for your content. You represent and warrant that:

  • you own or have all necessary rights, licences, consents, and permissions for your User Content (including the rights of every identifiable person depicted);
  • your User Content does not infringe any third party’s intellectual-property, privacy, publicity, or other rights;
  • your User Content complies with all applicable laws and these Terms.

3. Acceptable use

You will not, and will not attempt to, use the Website or Service to upload, share, link, or otherwise make available any content or take any action that:

  • depicts, promotes, or sexually exploits minors (any such material will be reported to Kripos and other competent authorities and is grounds for immediate termination);
  • depicts non-consensual intimate imagery, image-based sexual abuse, or imagery shared in violation of Straffeloven §267a;
  • infringes copyright, trademark, trade-secret, publicity, privacy, moral, or other proprietary rights of any person;
  • harasses, threatens, defames, stalks, or incites violence against any person, or constitutes hate speech under Straffeloven §185;
  • depicts graphic violence, self-harm, or content glorifying terror;
  • contains malware, exploits, or attempts to disrupt, probe, scan, or test the Service’s security;
  • impersonates any person or misrepresents your identity or affiliation;
  • violates any applicable law or regulation, including the General Data Protection Regulation, Markedsføringsloven, or Åndsverkloven;
  • attempts to scrape, mirror, reverse-engineer, or extract User Content of others, the Service’s source code, or its underlying data;
  • circumvents access controls, group invitations, or other security measures.

We may, in our sole discretion and without prior notice, remove any content and suspend or terminate any account that we believe violates these Terms, applicable law, or that creates risk or possible legal exposure for Kinfeed, our users, or third parties.

4. Our role: hosting platform, not publisher

Kinfeed acts as a hosting service as defined by Directive 2000/31/EC (E-Commerce Directive) and Regulation (EU) 2022/2065 (Digital Services Act), and lov om elektronisk handel (Ehandelsloven) §§16–18.

We do not select, edit, modify, monitor, endorse, or otherwise control User Content before it is uploaded. We do not pre-screen User Content. We are not the publisher of, and are not responsible for, User Content, and we do not guarantee its accuracy, integrity, lawfulness, or quality. Each user is solely responsible for the User Content they upload, share, or otherwise make available.

To the maximum extent permitted by applicable law, Kinfeed disclaims all liability for User Content and for any acts or omissions of users of the Service, including any harm, loss, or damage you may suffer as a result of User Content posted by another user.

5. Notice and action: illegal content

If you believe User Content on the Service is illegal or violates these Terms, send a notice to kontakt@kinfeed.com with subject line “Notice and action” including:

  1. your name and contact details (a Norwegian/EEA address is helpful for service of process);
  2. a sufficiently precise indication of the location of the content (group name, post, date);
  3. a clear explanation of why you consider the content illegal, with reference to the applicable law where possible;
  4. a statement, made in good faith, that the information in your notice is accurate and complete.

We will assess each notice without undue delay and act in accordance with the DSA and applicable Norwegian law. We may share your notice with the user who posted the content, except where disclosure is restricted by law (for example in cases involving child sexual abuse material or other matters subject to law-enforcement secrecy).

For copyright complaints, follow the same procedure and additionally identify the work alleged to be infringed and your basis for asserting the right. Repeat infringers will have their accounts terminated.

6. Intellectual property of Kinfeed

All rights in the Website and the Service, including the Kinfeed name, wordmark, logo, all underlying software, design, copy, photographs we provide, and brand assets, are owned by Jernkvern AS or its licensors and are protected by copyright, trademark, and other intellectual-property law. You receive no licence or right in our intellectual property except the limited right to use the Website and Service in accordance with these Terms.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Website or Service, except as inherent in normal use.

Our official social-media presence is limited to the profiles linked from the Website (Facebook, Instagram, LinkedIn). Any other account using the Kinfeed name or marks is not operated or endorsed by us. Those platforms are operated by third parties under their own terms; we are not responsible for their content, availability, or data practices. Messages sent to us on those platforms are not a valid channel for legal notices under these Terms; use the contact address in section 15.

7. No warranty

THE WEBSITE AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINFEED DISCLAIMS ALL WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, OR FREEDOM FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, KINFEED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT YOUR USER CONTENT WILL NEVER BE LOST, ALTERED, OR DELETED. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN INDEPENDENT BACKUPS OF ANY USER CONTENT THAT MATTERS TO YOU.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINFEED, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USER CONTENT, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE WEBSITE OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT KINFEED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

KINFEED’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE WEBSITE, OR THE SERVICE WILL NOT EXCEED ONE HUNDRED EUROS (€100) OR THE EQUIVALENT IN NOK.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including (i) liability for death or personal injury caused by our negligence, (ii) liability for fraud or fraudulent misrepresentation, (iii) liability for gross negligence or willful misconduct, (iv) statutory rights of consumers under mandatory Norwegian law, or (v) liability of Kinfeed as a controller under Articles 82 and 83 GDPR.

9. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Jernkvern AS, its affiliates, and their respective officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • your User Content;
  • your use or misuse of the Website or Service;
  • your breach of these Terms; or
  • your violation of any law or of any third party’s rights.

10. Suspension and termination

We may suspend or terminate your access to the Website or the Service at any time, with or without notice, for any reason or no reason, including if we reasonably believe you have violated these Terms or applicable law, or if continuing to provide the Service to you creates risk of harm to you, other users, or Kinfeed.

You may stop using the Service at any time and may delete your account from within the app. Provisions of these Terms that by their nature should survive termination (including, without limitation, sections on User Content licence after deletion, intellectual property, no warranty, limitation of liability, indemnification, and dispute resolution) will survive.

11. Changes to these Terms or the Service

We may modify these Terms or the Service at any time. The “Last updated” date at the top of these Terms will reflect the most recent change. For material changes, we will give reasonable notice (for example, via the app or email). Your continued use of the Website or Service after the effective date of the changes constitutes acceptance of the updated Terms.

We may, at our discretion and at any time, change, suspend, or discontinue any feature of the Website or Service, in whole or in part, with or without notice.

12. Force majeure

Kinfeed will not be liable for any failure or delay in performance under these Terms caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, pandemic, governmental action, fire, flood, earthquake, internet or telecommunications failure, infrastructure outage, or denial-of-service attack.

13. Severability and assignment

If any provision of these Terms is held to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, it will be severed from these Terms; the remaining provisions will remain in full force.

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.

14. Governing law and disputes

These Terms are governed by the laws of Norway, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or relating to these Terms, the Website, or the Service shall be brought exclusively before the competent Norwegian courts, with Oslo District Court (Oslo tingrett) as the agreed first venue.

Nothing in these Terms removes any non-waivable rights you may have under mandatory consumer-protection law in your country of residence.

15. Contact and digital-services contact point

For all matters relating to these Terms, including notice and action, GDPR rights, copyright complaints, and other legal correspondence, contact us at kontakt@kinfeed.com. This is also our designated single point of contact under the Digital Services Act for users and authorities. We accept communications in English and Norwegian.

By using the Website or the Service, you confirm that you have read, understood, and agree to these Terms.
